Product Terms and Conditions for TKM Ballistics

 

1. Scope of Application

1.1. All supplies and services are governed exclusively by these Terms and Conditions of Purchase. Deviations require express written acceptance by TKM. References to the supplier’s own terms of delivery are expressly rejected.

1.2. Quotations are free of charge and subject to confirmation. Work performed is subject to TKM Ballistics conditions of work and materials.

1.3. We only sell to business-to-business (B2B) or business-to-government (B2G) customers. You must be 18 years or older to purchase.

1.4. All customers must show proof of verification as a business security leader or government employee for any ballistic product to be sold.

 

2. Orders and Acceptance

2.1. Valid orders are written and signed or digitally confirmed by the Supplier. Verbal or telephone orders must be confirmed in writing by TKM.

2.2. If the customer doesn’t accept the order within 2 working days, TKM may cancel it. Thirdparty order transfers require TKM’s prior consent.

2.3. Products ordered from TKM’s custom design services require sample approval before series production.

3. Delivery and Deadlines

3.1. Delivery items must comply with TKM’s specifications and safety recommendations. Extra time may be required to QC and resolve potential issues on any custom designs. This extra time will not exceed (30) days.

3.2. Deliveries are complete upon receipt at the specified location. Excess deliveries may be returned at the supplier’s expense.

 

4. Prices and Payment

4.1. Bulk order pricing is dynamic, and quotes may or may not include shipping / packaging depending on customer communications.

4.2. Invoices must be submitted promptly after the order is placed. Production will not begin until a deposit of 65% of the total cost is received. The remaining balance must be paid (14) days after the time of delivery.

 

5. Quality and Inspection

5.1. The supplier guarantees that all products meet the agreed specifications and quality standards at the time of shipment.

5.2. Ballistic products must be replaced within the correct timeframe for warranties to be valid.

 

6. Regulatory Compliance

6.1. All products must comply with applicable local, state, and federal regulations regarding ballistic protection.

6.2. Suppliers must provide necessary certifications and documentation proving compliance with these regulations.

 

7. Usage Restrictions

7.1. Our ballistic protection products are intended for lawful use only and must be used in compliance with all relevant laws and regulations.

7.2. End-users are responsible for ensuring the appropriate and lawful use of the products.

 

8. Warranty and Liability

8.1. The supplier warrants that all products will be free from defects in materials and workmanship for a specified period from the date of delivery.

8.2. TKM Ballistics is not liable for any damages resulting from improper use, modification, non-replacement, or unauthorized repair of the products.

9. Export Control

9.1. Products are subject to export control laws and regulations. Suppliers must comply with all applicable export control requirements.

9.2. TKM Ballistics will not be liable for any violation of export control regulations by the supplier or end-user.
